These Terms & Conditions (“Terms”) govern your use of PakPicks Collective (“PakPicks”, “we”, “us”, or “our”), including our website, and any future mobile applications or related services we make available (together, the “Platform”). By creating an account, browsing, or placing an order, you agree to these Terms in full. If you do not agree, please do not use the Platform.
1. Who We Are
PakPicks Collective is an online marketplace that connects customers with independent Pakistani brands and vendors. PakPicks operates the Platform that enables these transactions — we are not the seller of the products listed. Each vendor is independently responsible for the products they list and sell.
PakPicks Collective's formal business registration is in progress. Until incorporation is complete, the Platform is operated by its founders and team on behalf of the business described herein. This does not affect your rights under these Terms.
2. Your Account
You must be at least 18 years old to create an account. You are responsible for keeping your login details secure. Any activity under your account is your responsibility. Notify us immediately at help@pakpicks.pk if you suspect unauthorized access.
3. Placing Orders
When you place an order, you are entering into a purchase agreement directly with the vendor, not with PakPicks Collective. We facilitate the transaction and provide the platform, payment coordination, and customer support, but we are not a party to the underlying sale contract between you and the vendor. Prices are shown in Pakistani Rupees (PKR) and include any applicable taxes unless stated otherwise.
4. Payments
Available payment methods are shown to you at checkout and may include Cash on Delivery (COD), bank transfer, mobile wallets, or card payments, depending on what is enabled at the time of your order. Payment must be completed according to the method you select. We do not store your full payment card details on our servers; any card or wallet payments are processed through our payment partners.
5. Delivery
Delivery times vary by vendor and location. Estimated delivery times are shown at checkout. PakPicks is not responsible for delays caused by couriers, vendors, or circumstances outside our reasonable control. You will receive tracking information once your order is shipped, where available.
6. Returns & Refunds
You may request a return within 7 days of delivery if an item arrives damaged, defective, or significantly not as described. We do not accept returns for change of mind. Contact us at help@pakpicks.pk with your order number and photos of the issue. Approved refunds are processed within 5–10 business days, using the original payment method where reasonably possible.
Some products may be made-to-order or custom-made by a vendor. Where this is the case, it will be indicated on the product listing, along with any additional information about production time or vendor contact requirements before dispatch.
7. Prohibited Use
You must not use PakPicks Collective to:
- Place fraudulent orders or use stolen payment details.
- Harass, threaten, or abuse vendors or our team.
- Attempt to manipulate reviews or ratings.
- Use the platform for any illegal purpose.
8. Intellectual Property
All Platform content — including our logo, design, and text — is owned by PakPicks Collective. Product content (images, descriptions) is owned by the relevant vendor and is used on the Platform under license from that vendor. You may not copy, reproduce, or distribute any Platform content without written permission.
9. Limitation of Liability
PakPicks Collective is not liable for the quality, safety, legality, or accuracy of products sold by vendors, as we are not the seller. To the maximum extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the Platform. Our total liability to you in connection with any order shall not exceed the value of that order.
10. Force Majeure
We will not be liable for any failure or delay in performing our obligations where that failure or delay results from causes beyond our reasonable control, including but not limited to internet or hosting outages, power failures, natural disasters, courier disruptions, government action, or public health emergencies.
11. Electronic Acceptance
By creating an account, checking any “I agree” box, or placing an order, you provide your electronic acceptance of these Terms, which is legally binding to the same extent as a physical signature.
12. Changes to These Terms
We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Platform after that date means you accept the updated Terms.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PakPicks Collective regarding your use of the Platform, and supersede any prior agreements or understandings.
15. Assignment
We may assign or transfer our rights and obligations under these Terms, for example in connection with a business restructuring, merger, or sale. You may not assign your rights under these Terms without our prior written consent.
16. Waiver
If we do not enforce any right or provision of these Terms on a particular occasion, this does not mean we waive that right or provision for the future.
17. Notices
We may send you notices relating to these Terms or your account via the email address associated with your account. You are responsible for keeping this address up to date.
18. Survival
Sections relating to intellectual property, limitation of liability, dispute resolution, and any other provision which by its nature should survive, will remain in effect after your account is closed or these Terms otherwise end.
19. Governing Law
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of Pakistan.
